In a society grappling with the complex issue of drug abuse, the prosecution of young individuals entangled in substance misuse raises pertinent questions about the approach towards tackling this pervasive problem. The stark reality is that the criminalization of young drug abusers often exacerbates the issue rather than addressing its root causes. In this blog post, we delve into the nuances of prosecuting young drug abusers, highlighting the need for a shift towards understanding and rehabilitation.
UNDERSTANDING THE DYNAMICS OF DRUG ABUSE
Drug abuse among the youth is a multifaceted issue influenced by a myriad of factors, including socio-economic conditions, peer pressure, and underlying mental health struggles. The portrayal of young drug abusers solely as criminals overlooks the underlying vulnerabilities and challenges they face. Instead of resorting to punitive measures, a more holistic approach that takes into account the complexities of drug abuse is imperative.
THE PITFALL OF PROSECUTION
According to Sec. 30 Criminal code Cap C38 L.F.N (2004)-Juvenile is a minor: child or young person who has not attained the legal age to be held criminally responsible.
A child is not criminally responsible (Labinjo vs Abake ‘1924’ 5NLR 33), they lack contractual capacity. Substance use and criminal behavior are interrelated as it results to drug abuse, then violence. It is common that most Juvenile violence results from substance-intoxication.
According to World Health Organization (WHO), there is an estimate of about 90% of Street Children being an influence of one hard substance or another, posing public health threat of about 30-100 million children worldwide(Child Abuse and Neglect. WHO Face Sheet No. 151. 2002, {last accessed 2024 January 26} http://www.who.int|inf-fs|en|fact151.html
The Child’s Right Act provides for the administration of Juvenile of a child and it made for the establishment of the family court vesting it with the provision of dealing with young offenders being assisted by Juvenile court the total welfare of young offenders.
Notwithstanding the offence committed by a young person, the Children and Young Peoples’ Act forbids the subjection to torture, inhuman treatment, or degrading punishment, detention of children (sec. 11(2)(3) 2003 As Ammended ) rather they should be kept in Committal to Rehabs, made to pay fine, put under probation.
Prosecuting young drug abusers through punitive measures such as incarceration often perpetuates a cycle of substance misuse and criminal behavior.
The criminal justice system, designed primarily for punitive purposes, may not effectively address the underlying issues driving drug abuse among the youth. Moreover, incarceration can have long-lasting detrimental effects on young individuals, hindering their prospects for rehabilitation and reintegration into society.
RETHINKING THE APPRAOCH TOWARDS REHABILITATION
A paradigm shift towards rehabilitation instead of prosecution is crucial in addressing the challenges posed by young drug abusers. Rehabilitation programs that focus on education, counseling, and skill development offer a more sustainable solution to breaking the cycle of drug abuse. By providing young individuals with the support and resources they need to overcome substance misuse, we can empower them to lead healthier and more fulfilling lives.
As an adult, the experience of both incarceration is really scary and for a young offender, having them incarcerated and having their case publicized by the press is even more “scary.” -“oh my face is on out there, my name is on the social media, everything etc., what will my school folks gets to about me?, etc..
Reporters or news articles may make news, and want to publicize it- forgetting the psychological trauma it will have on these young ones.
…the Children and Young peoples’ Act prohibits trial publicity of young offenders notwithstanding the nature of offence committed….
Journalists are advised to think about their language in stories, such as “child” instead of “juvenile” and putting youth crime reports in the context of national, state and local trends.
THE ROLE OF SOCIETY AND SUPPORT STYSTEM
Juvenile Prosecution has a higher risk of exposing young person to lifelong notoriety and this is a factor which the law enforcement agencies have not thought it wise to consider.
Can you picture a 10 year old drug addict in an adult detention- going through the adult criminal legal system?. We know that adult criminal facilities are set up to have major criminals living there, what does this reflect? young offenders will be in their cell 23/24 hours a day because they have to be segregated from adults and they cannot stand the sight of those adult as the exposure has an immeasurable effect in the life of these young offenders.
Solitary confinement is akin to torture
Creating a supportive environment for young drug abusers is essential in their journey towards recovery. Rather than stigmatizing and alienating them, society can play a pivotal role in facilitating rehabilitation and reintegration. Offering access to mental health services, community support programs, and educational opportunities can significantly enhance the prospects of young individuals seeking to overcome drug abuse.
